North Dakota Higher Ed wants to exempt "trade secrets" from records law

A bill that will be introduced this session by the North Dakota Board of Higher Education aims to keep proprietary and commercial information confidential.

Exempting trade secrets and other sensitive information from the open records law is essential for universities to form partnerships with private companies, said Dale Zetocha, executive director for the North Dakota State University Research Foundation.

“If the legislation isn’t passed, it could have a negative effect on the university’s ability to really help and assist businesses where intellectual property and confidentially are key things to protect,” Zetocha said.
