Bill that would give Del. AG FOI enforcement power dies
When he was campaigning for attorney general, Beau Biden pledged to work to
revise the state's Freedom of Information Act so that the Attorney General's
Office is not required to represent the state in FOIA cases brought against a
state agency.
The promise was one of the planks of his platform.
The state's awkward system requires the public to sue a state agency in
Chancery Court over access to documents, meetings or other official information
if the agency refuses or ignores a FOIA request. The Attorney General's Office
is required to represent the state agency.
Biden's pledge was hailed as an important step toward a more open government.
But legislation Biden supported to allow the Attorney General's Office to
determine whether a state agency had violated the FOIA law died in committee.
