Albany reporter subpoened; SPJ Prez quoted in NY Times

One of our favorite topics on this blog is situations in which reporters are subpoened by courts. Few things get a group of journalists blood boiling more than that. The latest is an ethics panel at the New York Legislature subpoenaing information from a reporter at the Albany Times Union. James Odabato, a statehouse reporter, apparently has information about a scandal involving Gov. Eliot Spitzer. Rightly, the paper is not cooperating.

Dave Aeiken would benefit from a college course in standard english.  He is setting aside journalistic objectivity by stating his opinion regarding the newspaper decision not to cooperate with New York Legislature.  Should readers consider this a report or an editorial?   I am confused.
